Federal servicing rules (Regulation X) require most servicers of federally related mortgages to evaluate a "complete" loss mitigation application before proceeding to foreclosure. This generally applies to conventional, FHA, VA, USDA, Fannie Mae, and Freddie Mac loans — the large majority of Texas mortgages.

How to Confirm Yours

Exceptions and nuances exist depending on loan size, servicer size, and loan type. Ask your servicer directly which investor owns your loan and whether it's subject to loss mitigation requirements, or have a free HUD counselor pull that information for you. Don't assume either way — confirm it.
